Ala. Police: Taser Use on Disabled Man Justified

(Published on Tuesday, July 28, 2009 by the Associated Press) MOBILE, Ala. - Officers who used pepper spray and a Taser to remove a man from a store bathroom found out only later he was deaf and mentally disabled and didn't understand they wanted him to open the door, police said Tuesday. A spokesman for the Mobile Police Department said the officers' actions were justified because the man was armed with a potential weapon -- an umbrella. But relatives of Antonio Love, 37, have asked for a formal investigation and said they plan to sue both the police and the store. "I want justice," Love's mother, Phyllis Love, said Tuesday. The woman said her son hears only faintly, has the mental capacity of a 10-year-old and didn't realize that it was the police who were trying enter the bathroom. "He thought the devil was out there trying to get in to get him," she said. Antonio Love, in a written statement and in a television interview given in sign language about the confrontation, said he had a badly upset stomach last Friday and went into a Dollar General store to use the restroom. Police spokesman Christopher Levy said Tuesday store workers called officers complaining that a man had been in the bathroom for more than an hour with the door locked. Officers knocked on the door and identified themselves, but the person didn't respond. Officers used a tire iron to open the door, but the man pushed back to keep it shut. Officers saw the umbrella and sprayed pepper spray through a crack trying to subdue the man, Levy said. They shot the man with a Taser when they finally got inside, he said. Officers didn't realize Love was deaf or had mental problems until he showed them a card he carries in his wallet, Levy said. He was arrested on a charge of disorderly conduct, but officers released him and took him home after a magistrate refused to issue a warrant. Levy said officers were justified in using force against Love since he had an umbrella. "The officers really worked within the limits of our level-of-force policy," he said. "We had no information about who this guy was." Phyllis Love said her son, who has worked in the garden department at a Lowe's store for several years, was scared when he realized someone was trying to get into the bathroom with him. He put water on his face and on the floor after being hit with pepper spray, she said. "He didn't know it was a policeman until they busted the door in on him," she said. "He had a knot on his head from where it hit him." Levy said police wish the confrontation had never occurred. The internal investigation will include a review of Love's complaints that officers laughed at him after realizing he was deaf, he said. "We'll make whatever efforts we can to resolve this situation, hopefully so this man will be able to trust police in the future so we can help him. Obviously, it's going to be a rough road," he said.

By James Polk, Drew Griffin and Kate Albright-Hanna CNN,Tuesday, May 23, 2006 Posted: 1503 GMT (2303 HKT) NEW ORLEANS, Louisiana (CNN) -- Autopsy results obtained by CNN show a mentally disabled man was shot in the back when he was killed by New Orleans police in the aftermath of Hurricane Katrina. This contradicts testimony by a police sergeant that the victim had turned toward officers and was reaching into his waistband when shot. "Clearly he was shot from behind," said famed New York pathologist Dr. Michael Baden, who examined the body for the family's lawyer. (Watch where the man died and details of the autopsy -- 5:04) A prosecutor said the case will go before a grand jury soon and acknowledged the investigation includes the possibility of police wrong-doing. Ronald Madison, 40, was mentally disabled and lived at home with his mother. He had no criminal record. He was shot when police responded to a report of gunfire on a bridge over the flooded Industrial Canal on Sunday, September 4, six days after Katrina hit New Orleans last year. It was a week of dire flooding, rampant looting, death by drowning. Police were strained, beset by suicides and desertion. Four people were killed in confrontations with police that weekend alone. Madison's older brother, Lance, said he and Ronald were walking across the Danziger bridge toward another brother's dental office when teen-agers ran up behind him and opened fire that Sunday morning. By his account, he and Ronald were running away toward the crest of the bridge when a police team, responding to the report of gunshots, arrived in a rental truck and opened fire on people on the bridge. Police Superintendent Warren Riley told CNN, "Several of the people were shot and two were killed by our officers in a running gun battle... Most police shoot-outs last somewhere between six and twelve seconds, and it's over with. This was a running gun battle that went on several minutes." One teen-ager, still unidentified, was killed near the base of the bridge. Another was critically wounded. Three other people with them were also shot and were hospitalized. Lance Madison said a policeman pointed a rifle at Ronald and shot him as the two of them were running up the bridge. Lance said he helped carry his wounded brother to a motel on the other side of the canal and left him there as Lance kept running to seek help. The Police Department said in a press release last fall that Ronald Madison, whom it called a second unidentified gunman, "was confronted by a New Orleans Police Officer. The suspect reached into his waist and turned toward the officer who fired one shot fatally wounding him." Testifying in a preliminary hearing last fall, Police Sgt. Arthur Kaufman said much the same thing: "One subject turned, reached in his waistband, turned on the officers." Autopsy results, made available to CNN by a source involved in the investigation, directly contradict that police account. The findings list five separate gunshot wounds in Ronald Madison's back. Three went through the body and exited in front. There were two other wounds in his right shoulder. None of the shots entered his body from the front. CNN had sued the coroner of Orleans Parish to try to get official access to the autopsy report. At a court hearing on that lawsuit in New Orleans a week ago, the coroner, Dr. Frank Minyard, verified the handwritten autopsy report obtained elsewhere by CNN was indeed prepared in his office by a pathologist on his staff who listed the wounds in the victim's right back. Under cross-examination by a CNN lawyer, Dr. Minyard testified those five wounds in the back "were entrance wounds, yes." Dr. Michael Baden, chief forensic pathologist for the New York State Police, met with CNN in New York City two weeks ago to discuss his own observations when he examined Ronald Madison's body for the family lawyer last fall. Asked if Ronald could have been facing the police when shot, Dr. Baden said, "Absolutely not." No weapon was found on or near Ronald Madison's body. Assistant District Attorney Dustin Davis, testifying in the same court hearing on the CNN lawsuit, said a grand jury has been assigned to investigate the Danziger Bridge shootings. However, the grand jury has not yet met on the case because the New Orleans Police Department has yet to complete its final report, eight months after those deaths. The CNN attorney asked Davis, "What you are investigating in that case is whether any of the police officers may be indicted for homicide, is that correct?" Davis answered, "That's partially correct. We are also looking at Mr. Madison's involvement in the incident." Lance Madison was arrested on the other side of the bridge where his brother was killed and was accused of shooting at the police officers in the gun battle. He, too, had no weapon when taken into custody. He was released from jail after six months because the District Attorney's office had not initiated any prosecution, although the investigation remains pending. Sgt. Kaufman testified at the bail hearing for Lance Madison last fall that another policeman saw Lance throw a gun into the Industrial Canal as he was going over the bridge. Lance Madison denies that. He told CNN correspondent Drew Griffin, "I had no gun, at all." Asked if Ronald had a gun, Lance answered, "No, he didn't." In a CNN interview earlier this month, Griffin told Police Chief Warren Riley, "We understand Ronald Madison was shot in the back five times." Riley said, "Those are things I can't comment on and no one can comment on until the investigation is concluded." Griffin asked Riley if he was concerned about his officers' actions and Riley replied, "Certainly, we do not condone our officers overreacting, even in the most chaotic time," but he went on, "We don't know that they overreacted. From the radio transmission, it sounds like their lives were in danger." Riley turned down a request by CNN to interview the officers who were involved. A 25-year career employee at Federal Express, Lance Madison has no criminal record. At the end of the CNN interview, Riley conceded the two Madison brothers may not have been connected with the other people on the bridge that day. "I don't know if those young men were innocent or not. I really don't know if they were with that group or not," Riley said. "I really don't know."

Cop Beats Up Disabled Man

It looks like 3 minutes and 17 seconds of terror for one man. Passaic, N.J., police were investigating an incident where a cop beats a man who may have a mental disorder. The incident, recorded on surveillance video, shows the man does not appear to resist the officer. On Saturday, angry residents plan to protest outside City Hall. Ronnie Holloway, 49, said he did nothing to provoke the May 29 attack. The tape shows the officer getting out of his car, heads for a man standing on a street corner and starts swinging. Holloway was charged with resisting arrest, disorderly conduct and wandering with the intention of buying drugs. Holloway's mother said her son has schizophrenia but takes his medication and is not violent (zip up to cover his chest.....fuck you.the man can walk around with an open shirt/coat)

Disabled are only Discounted in Hollywood: Time for Change

I go into businesses and companies and I'm fully accepted in the corporate world, but not when it comes to a TV show or film project," actress Teal Sherer explained. "I want to bring attention to the problems that performers with disabilities face. Nothing is going to change unless we speak out. We're a minority and we're being overlooked." If you sense Sherer is a strong woman with a vision, you're right. As the Communications Director of the Screen Actors Guild Performers with Disabilities Committee, she is using her voice for change. In 1995, Sherer was a freshman in high school when she got into a car to go see fireworks on Labor Day with a driver she had just met. "It happened really fast. I broke my back in the car accident and suffered a spinal cord injury. Paralyzed from the waist down, I found myself in a wonderful rehab center in Atlanta, the Shepherd Center, with other teenagers who were worse off than me. One of the girls had been shot and she couldn't move any of her limbs and it even affected her speech. I realized how lucky I was that I could move my upper body," Sherer remembers. "My life changed dramatically after the accident. Had this not happened, my life would be boring, I would have stayed in Tennessee, gotten married and drifted into middle age. After this happened, I realized I could do anything." Sherer went onto college and majored in Communications/Broadcasting, where she enjoyed an acting class and got involved in theatre productions. In 2005, the HBO project "Warm Springs," was filming in Atlanta. She earned a part in the film that focused on Franklin Delano Roosevelt, who was left a paraplegic from polio at 39. The film, starring Kenneth Branagh, followed FDR's struggle with paralysis and his return to public life and politics. "I helped Kenneth to understand disabilities. We went swimming together. I showed him how to walk with braces. It was a wonderful opportunity," Sherer said. "I moved to Los Angeles almost three years ago. I can't live on my acting income because I only have ten auditions a year. There just aren´t that many parts that are written for a wheelchair user. My goal is to get into the audition. I can play a teacher or a girlfriend, I can do anything anyone else can do. I don't only have to play disabled characters. We can play real people because we are real people." Sherer did find recent success on the pilot "I'm With Stupid" for NBC Television. "Wil Calhoun wrote the pilot. It was about a friendship with a guy in a wheelchair and based on the BBC series of the same name. I was cast as a regular, but it wasn´t picked up. Last week I had a commercial role audition and I booked another commercial for Highmark Insurance, but it´s only running in Pennsylvania," Sherer said. "The battle is clearly uphill. I know it´s hard for able-bodied actors as well to break into the industry. But, we just want to have the same opportunities. We feel hidden by TV and film producers. It's very rare that producers want to use us. Sometimes we get auditions but it´s only as a favor to someone we know." Sherer is simply searching for fair access. "We feel excluded from the process. If more writers were writing parts that showed disabilities or if producers had an open-minded spirit toward disabilities, it would be easier. They're already casting different ethnicities and colors, but we're far behind them. We're not even on a pie chart of the Casting Data Report showing diversity," Sherer said. With the upcoming 2008 performances of "The History of Bowling," which Sherer is co-producing with actor Danny Murphy, she hopes to bring attention to performers with disabilities. "I do have hope. I'm pursuing the entertainment industry because I'm positive we can make a change. It's about creating it for yourself and I'm interested in all aspects of writing, producing, and performing. I'm currently studying at the Improv with the Groundlings. With the recent writer´s strike, it's ironic, but with participating on the picket line, it's brought the performers with disabilities together and made us a stronger unit. In the meantime, I do temporary work as an assistant in the entertainment industry. In the corporate world, there is no discrimination. They all want to hire me and entertainment companies greet me with open arms. It's ironic," Sherer added. Not one to sit around and wait for opportunity, she is working on an idea for a documentary to take everyone to task who parks in a handicapped parking space. "It drive me crazy. Just the other day, I saw this beautiful woman leave Starbucks. I couldn't find a parking space, but she found one right up front. It was a handicapped space and she was walking just fine. She clearly wasn´t handicapped. We need a documentary to attack the subject. It's almost 2008 and there are too many handicapped placards being given out or misused," Sherer explained. "I see opportunities to create documentaries because you have to stand up for what is right." Sherer has also written articles for New Mobility Magazine and she's involved with Wheels for Humanity in North Hollywood. "Wheels for Humanity is an incredible organization. They refurbish donated wheelchairs and hand fit them to children and adults with disabilities in third world countries. We just got back from Tijuana where we gave 100 wheelchairs to people who needed them. A wheelchair can change a life. We receive corporate and individual donations, but a lot of wheelchairs end up in landfills. Wheels for Humanity has helped nearly 35,000 people with disabilities since 1996," Sherer added. "If we can get wheelchairs to people in third world countries, we can get performers with disabilities up on the screen." According to celebrity website TMZ.com, author Jordan Scott claims in a cease and desist letter obtained by the website that Meyer lifted parts of Breaking Dawn from Scott's 1996 vampire tale The Nocturne. The letter claims several similarities in the plots and in the wording of several passages, but a representative for Meyer dismissed the allegations out of hand. "The claim that Breaking Dawn by Stephenie Meyer somehow infringes on an alleged book by someone named Jordan Scott is completely without merit. Neither Stephenie Meyer nor her representatives had any knowledge of this writer or her supposed book prior to this claim."

Climate protection 'to cost more'

Protecting societies against the impacts of climate change will be much more expensive than previously believed, according to a new analysis. In 2007, the UN climate convention came up with a sum of $49-171bn per year. The new report says the UN sums omitted important factors and the true cost will be two to three times higher. Developing nations want rich countries to provide major sums for adaptation as part of the new UN climate deal due to be agreed in Copenhagen in December. "The amount of money on the table at Copenhagen is one of the key factors that will determine whether we achieve a climate change agreement," said lead author Martin Parry, a visiting research fellow with the Grantham Institute for Climate Change at Imperial College London. "But previous estimates of adaptation costs have substantially misjudged the scale of funds needed." Professor Parry co-chaired the Intergovernmental Panel on Climate Change (IPCC) working group on climate impacts for its 2007 assessment. The new report - issued under the aegis of the International Institute for Environment and Development (IIED) and the Grantham Institute - says that some aspects of the UN estimates were wrong by a factor of more than 100. Call to caution The UN climate convention (UNFCCC) made its assessment in 2007 after the IPCC concluded the task was too difficult; and Professor Parry suggested it had been done in a hurry, with some vital caveats ignored in subsequent deliberations. A spokesman for the UNFCCC defended the process but said the organisation had a responsibility to be conservative. "Looking at what was out there in 2007, these were best estimates, which we simply collected; and we had to err on the side of caution," he said. Recently the UNFCCC's executive secretary Yvo de Boer has tended to use the figure of $100bn (£60bn) per year. Professor Parry told BBC News that a key point of the new report, Assessing the Costs of Adaptation to Climate Change, was that it included "bottom-up" as well as "top-down" analyses. "One study shows the cost of adapting a single watershed in China - that's one of the few case studies that's been done - comes in at a billion dollars a year," he said. "So when you start adding up the various figures you soon start to exceed the global number (in the UN's analysis)." He said UNFCCC calculations had taken into account only half of the extra disease burden due to emerge from climate change, assumed low levels of future development in Africa (so giving less infrastructure to protect), used low estimates for sea level rise and had not included the economic costs of nature loss. Mr de Boer told BBC News he was happy that thinking and understanding on the issue was evolving. "For me, the priority is not to try and determine with scientific precision exactly how much is going to be needed to cover the cost of adaptation in 2030," he said. "The point is to put in place a robust architecture for raising adaptation funds and allocating them over time." Financial key Securing funds for climate protection, or adaptation, is a key priority for developing countries in the run-up to the Copenhagen conference, which is supposed to secure a new global agreement supplanting the Kyoto Protocol. Earlier this week the African Union suggested it would be asking for $67bn (£40bn) per year for Africa alone. "Finance is the key that will unlock the negotiations in Copenhagen," said IIED director Camilla Toulmin. "But if governments are working with the wrong numbers, we could end up with a false deal that fails to cover the costs of adaptation to climate change." Most is expected to be raised through levies on carbon trading, but Mr de Boer believes developed countries will need to pledge an up-front sums in the region of $10bn to enable poorer nations to begin assessing their needs and priorities. SPCA exec's dog dies after being left in hot car

The 16-year-old dog dies of kidney failure after being left for four hours updated 2:56 p.m. ET Aug. 26, 2009 RICHMOND, Virginia - An executive for an anti-animal cruelty group says her 16-year-old blind and deaf dog died after she accidentally left him in her hot car for four hours. Robin Starr, the CEO of the Richmond Society for the Prevention of Cruelty to Animals, says she didn't realize "Louie" was in the car until noon. Starr's husband, Ed, told the Richmond Times-Dispatch he put the dog in her car as she got ready for work Aug. 19. She often took the dog to work with her. Robin Starr took the dog to two clinics, but he died of kidney failure. The National Weather Service says the temperature had reached 91 degrees by noon that day. The board of the SPCA says it still supports Starr, who has been CEO since 1997 and does not plan to resign. It was unclear whether she would be charged

Police 'steal' from unlocked cars

It is not uncommon to find items stolen from unlocked cars but it unusual for the 'culprit' to be a police officer. Officers in Richmond, south-west London, are entering unlocked cars to remove valuables, like handbags and laptops, leaving a note for the driver. Supt Jim Davis admitted, "technically we are entering the vehicle" but he denied breaching any law. But a leading lawyer said police could face civil proceedings for trespass if any items taken by them were damaged. Orlando Pownall, QC, who lives in Richmond Hill, said: "It undoubtedly is a trespass but there could be civil proceedings if a person shows a damage or loss has resulted from the trespass. "Police need to ensure that information on a computer or mobile is not looked at and kept in a secure place - otherwise it could be an intrusion. "It might also be worthwhile for officers to take a photo like traffic wardens." Officers try to contact the owner, failing which they remove the item and leave a note for the driver to retrieve it from Twickenham police station. In 2008 1,300 thefts from cars were reported in the borough, of which 220 involved sat-navs. But the figure rose by 40% until July. Mr Davis said: "We identified that 21% of thefts from cars were from unlocked cars, so no sign of forced entry. "Technically we are entering the vehicle but we are not committing a crime. It's a common law duty to protect (people's) property. "We don't want to take people's property as it is an awful lot of bureaucracy and hassle for us but we are doing this to make sure people take responsibility of their valuables." Until now 25 cars were targeted but an item had to be removed in only one case. Mr Davis said the police received "no negative complaints" so far. Richmond Council said it backed the scheme.

Toxic Mercury Found In 300 Streams In The USA

A federal study of mercury contamination released Wednesday found the toxic substance in every fish tested at nearly 300 streams across the country, a finding that shows how widespread mercury pollution has become. U.S. Geological Survey scientists say they have detected mercury contamination in every fish sampled in 291 streams across the United States. The USGS said about a quarter of the fish were found to contain mercury at levels exceeding the U.S. Environmental Protection Agency's criterion for the protection of people who consume average amounts of fish. More than two-thirds of the fish exceeded the EPA level of concern for fish-eating mammals, the scientists said. According to researchers the main source of mercury to most of the streams tested, is emissions from coal-fired power plants. The mercury released from smokestacks rains down into waterways, where natural processes convert it into methyl-mercury, a form that allows the toxin to wind its way up the food chain into fish. The USGS study found some of the highest levels of mercury in fish in the "black-water" streams in North and South Carolina, Georgia, Florida and Louisiana. High levels of mercury in fish also were found in relatively undeveloped watersheds in the Northeast and the Upper Midwest. Elevated levels were noted in areas of the Western United States affected by mining. Mercury, a neurotoxin, is one of the most serious contaminants threatening our nation’s waters. Mercury has been known to damage the nervous system and cause learning disabilities in developing fetuses and young children. Alaska and Wyoming are the only states that haven't issued fish-consumption advisories because of mercury contamination. Some of the streams studied already had warnings. The Obama administration said it would begin crafting new regulations to control mercury emissions from power plants after a federal appeals court threw out plans drafted by the Bush administration. The Bush plan would have allowed power plants to buy and sell pollution credits, instead of requiring each plant to install equipment to reduce mercury pollution.

Obama Vs Bush=Same Asshole

This weekend, over the course of of researching for a few articles, I discovered two cases that have striking similarities involving President Obama and former President Bush. Both had similar things happen to them, but were they covered equally? There has been a long history of media bias, for both sides of the aisle, for many years. Conservative bias has been alleged in Fox News, the Wall Street Journal, the Washington Times, The New York Post, and talk radio. Liberal bias has been alleged in MSNBC, the New York Times, the Washington Post, NPR, ABC, CBS, CNN, and many of the political blogs out there. I happen to think that the mainstream media happens to be more bias in favor of the Democratic Party, thus they get more positive coverage and the Republicans tend to get more negative coverage. In the past few weeks, the public has been mobilized over the health care reform debate which has seized the country. There have been some crazy people out there, but for the most part people have legitimate concerns over what will be reformed and have come to ask questions and express their opinion. Both sides are represented, but the opponents of the Democratic reform effort have larger numbers and tend to be more assertive. Public opinion has shown the majority of the country is now opposed to efforts by President Obama and congressional Democrats to reform healthcare, 53% to 42%. Well, why that has gone on, there have been those extremists and outspoken individuals who have been comparing President Obama to Adolf Hitler. They have said he is going to destroy the country and is a dangerous man. Some posters have even been floating around at rallies. The media has been up in over the comparisons, often showing footage and photographs of the posters. Even the likes of conservative talk show host Rush Limbaugh has compared Obama to Hitler. Another thing that has outraged many people are the Obama Joker posters, which have appeared across the country. They depict the President as the late Heath Ledger in the film "The Dark Knight." Liberals have expressed great anger that people would portray Obama this way and call it disturbing. I agree that with the outrage. I do not think it is appropriate to portray the President as Adolf Hitler or as The Joker. I find it to be in poor taste. Well, I did not notice any such outrage when this happened to President Bush. MoveOn.org ran an ad of President Bush, comparing him to Adolf Hitler. In addition, liberal commentators like Keith Olbermann have compared Bush to the Nazi Leader who killed 6 million Jews. There was hardly a peep out of the mainstream media over the case. There was also a depiction of President Bush as The Joker in Vanity Fair. Again, the media did not comment and no attention was paid to this case either. Both of the examples I used are identical comparisons to two different men, of two different political parties. The media and the public have been informed over the Obama comparisons, but the Bush ones were all but ignored. This begs the question, that is there a media double standard? I believe that these examples makes a good case for such an argument. Both presidents were extremely popular with their base and unpopular with the other side of the aisle. Despite this, President Obama has been portrayed as a victim of sorts, with these attacks, and President Bush was portrayed as deserving of them. This is merely my observations after coming across examples of these cases. You decide for yourself
